The United Heritage companies will not be bound by requests or information submitted to United Heritage via the Internet, email, or any other electronic method.

The companies are not accepting applications from residents of any state or country in which they are not licensed.

The content on United Heritage Sites is provided "As Is" and “As Available” and is not intended to be an offer to sell, a solicitation, or an advertisement of any product or service in any jurisdiction. Any inquiries regarding the purchase of a product from United Heritage will be directed to a licensed agent/producer. UNITED HERITAGE MAKES NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. UNITED HERITAGE MAKES NO REPRESENTATION OR WARRANTY THAT UNITED HERITAGE SITES WILL OPERATE UNINTERRUPTED OR BE FREE FROM ERRORS. AS PERMITTED BY LAW, UNDER NO CIRCUMSTANCEs WILL UNITED HERITAGE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING CONSEQUENTIAL, INCIDENTAL, SPECIAL, DIRECT OR INDIRECT DAMAGES, LOSS OF USE, LOSS OF DATA, LOSS CAUSED BY A VIRUS, CLAIMS OF THIRD PARTIES, OR OTHER LOSSES OF ANY KIND OR CHARACTER, REGARDLSS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES ) ARISING OUT OF THE USE OF OR INABILITY TO USE THE INFORMATION, SERVICES, SOFTWARE, OR OTHER ITEMS PROVIDED ON UNITED HERITAGE SITES OR ANY WEBSITE WITH WHICH IS LINKED. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF US, OUR LICENSORS, EMPLOYEES OR AGENTS TO YOU, OR ANY OTHER PARTY EXCEED, IN THE AGGREGATE, THE AVERAGE MONTHLY CHARGES ACTUALLY PAID BY YOU TO US OVER THE PRECEDING THREE (3) MONTHS. YOUR CLAIM FOR SUCH DAMAGES IS OUR SOLE LIABILITY, AND YOUR EXCLUSIVE REMEDY, IN THE EVENT OF THE BREACH BY US OF THIS AGREEMENT. THE FORGOING SHALL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY YOU MIGHT HAVE. No action, regardless of form, arising out of the transactions under this agreement may be brought by you more than twelve (12) months after the cause of action first arose.

You agree to indemnify and hold us harmless from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from use of the United Heritage Sites, including, but not limited to, any violation of this agreement, or the failure to fulfill any obligations relating to use of the Sites.

You further warrant that you will not use any electronic communication feature of the United Heritage Sites for any purpose that is abusive, tortious, intrusive on another's privacy, harassing, libelous, defamatory, obscene, threatening, hateful, or otherwise unlawful; you will not post any materials that infringe on rights of third parties; and, you will not upload or transmit any virus or other malware.

Any reference to coverage given on United Heritage Sites is intended to be descriptive in nature and for informational purposes only. Products and provisions described may not be available in all states. A written policy contains a complete description of benefits, provisions, limitations, and exclusions, and in the event of a conflict between descriptive information on United Heritage Sites and a policy, the policy will prevail.

The unauthorized use of or access to portions of United Heritage Sites that require password authentication is prohibited. Such unauthorized use or access, whether actual or attempted, may be subject to criminal and/or civil prosecution.

If you are authorized to access restricted portions of United Heritage Sites, do not share your password with anyone. You are solely responsible for maintaining the confidentiality of your password. If you suspect any unauthorized activity related to your account, contact United Heritage. United Heritage will not be responsible if you fail to properly secure your password or choose to share your password with any other person.

United Heritage Sites may provide links to third party websites for your convenience and information. These third party websites are not maintained by United Heritage and should not be interpreted as being affiliated with, endorsed, or sponsored by United Heritage. United Heritage is not responsible for any content, products, or services maintained on these third party websites.

Personal information transmitted to United Heritage will be treated in accordance with our Privacy Notice. These Terms and Conditions of Use incorporate the Privacy Statement set forth on the United Heritage Sites as the same may be modified from time to time. Continued use of our website is your acknowledgement and acceptance of the practices set forth in our Privacy Notice.

United Heritage owns and holds all intellectual property and proprietary rights, title, and interest in the United Heritage Sites, and owns the copyright to all text and certain graphic images on United Heritage Sites. All names, logos, slogans, icons, and graphics utilizing the same or a variation thereof, including but not limited to the name "United Heritage," the "landing eagle" logo, the slogan "Dream Big. Plan Smart." are the intellectual property, trademarks, and/or service marks of United Heritage. Any infringement of these proprietary rights is prohibited and your use of the same does not transfer any rights in the same to you. Other parties' trademarks and service marks that may be referred to herein are the property of their respective owners. The information contained on United Heritage Sites is provided for the personal use of our Site visitors , but such information may not be distributed or modified nor links made to United Heritage Sites without the prior written consent of United Heritage.  UNAUTHORIZED COPYING, REPRODUCING, REPUBLISHING, UPLOADING, DOWNLOADING, POSTING, TRANSMITTING OR DUPLICATION OF ANY OF THE MATERIAL ON UNITED HERITAGE SITES IS PROHIBITED.

When you provide a check as payment, you authorize United Heritage to use information from your check to make a one-time electronic fund transfer from your account or to process the payment as a check transaction. When we use information from your check to make an electronic fund transfer, funds may be withdrawn from your account as soon as the same day you make your payment, and you will not receive your check back from your financial institution.

You and we agree, pursuant to the E-Sign Act ('the Electronic Signatures in Global and National Commerce Act', as it may be amended from time to time), to treat electronic tokens of assent from you and from us, as binding expressions of assent by you and by us to contracts.

United Heritage may terminate your access to United Heritage Sites for any reason, without prior notice.

The Untied Heritage Sites, any information provided from them and these Terms of Use are given and made in Idaho, U.S.A. These Terms and Conditions of Use shall be governed and construed by the laws of the State of Idaho without giving effect to any conflict of laws principles or provisions and suit, if any, must be brought exclusively within the courts of the State of Idaho, Ada County.

These Terms and Conditions of Use contain the entire understanding between us with respect to any use of the Website. If a court of competent jurisdiction deems any provision of these Terms and Conditions of Use unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect.
